To: All individuals who were employed in California as non-exempt employees by Lubrizol Advanced Materials, Inc. and ExtruMed, Inc. dba Vesta at any time during the period from August 7, 2014, through February 2, 2024. You may be eligible to receive money from an employee class action lawsuit (“Action”) against Lubrizol Advanced Materials, Inc. and ExtruMed, Inc. dba Vesta (“Defendants”) for alleged wage and hour violations. The Action was filed by a former employee, Nghia Phuoc Kieu (“Plaintiff”), and seeks payment of back wages, penalties, and other relief for a class of hourly, non-exempt employees (“Class Members”) who worked for Defendants during the Class Period August 7, 2014 through February 2, 2024, and (2) penalties under the California Private Attorney General Act (“PAGA”) for all hourly, non-exempt employees who worked for Defendants during the PAGA Period May 31, 2017 through February 2, 2024, (“Aggrieved Employees”).
